1. Eligibility

LV Elite Membership is exclusively available for the members belonging to any of the below categories:

• Indian Citizens
• Persons of Indian Origin (PIO)
• Non Resident Indians (NRI)
• Persons who intend to marry persons of Indian Origin.

As an LV Elite member, you are believed to be eligible for marriage and conforming to the below:

• 18 years or above (for female) or 21 years or above (for male)
• Legally competent to marry as per the applicable Indian Law
• Not prohibited or prevented by any applicable law (in force) for the time being from entering into a valid marriage

3. LV Elite membership - Registration Process

• Post satisfactory response to User queries, once User intend to register for LV Elite service, a call is arranged with our experts to understand User profile and requirement in detail. Basis the essential details furnished by User, our experts will evaluate the profiles available with LoveVivah.com and then offer User the best possible package and process the registration of user with LV Elite. We expect User to be fair and honest while furnishing the personal information. The efficiency and effectiveness of match making will depend upon the accuracy and completeness of the information shared by User. User shall be responsible or liable for any information provided to LoveVivah. In order to serve User better if LoveVivah requires additional details User agrees to provide the same to LoveVivah. The information shared by User will be shared with other relevant LV Elite members on “as-is” basis and LV Elite members shall be solely liable for the information shared.
• If at any point of time, the information furnished by Member or User while registration proves to untrue, inaccurate, or incomplete then LoveVivah shall have full right to suspend or terminate Member membership and forfeit the amount paid by the member towards LV Elite membership fee and refuseLV Elite service to such Member thereafter without any reason whatsoever.

4. Tenure

Tenure of the LV Elite service shall dependent upon the service package offered by LoveVivah.com and as agreed upon by the Member. LoveVivah shall not be bind to extend the duration of the service beyond the tenure as agreed while registration. Any extension of service beyond the tenure shall be on the sole discretion of LoveVivah on case to case basis.

5. Role and Responsibility of LoveVivah w.r.t. LV Elite

• LoveVivah will ensure the privacy and security of all the data and information shared by LV Elite Member. Any details of Member will be shared with other relevant & prospective LV Elite Members only after receiving due consent.
• Upon signing up for LV Elite, user shall form a part of the elite and confidential group of Elite Members. The Member agrees to abide by the Terms of Usage, Privacy Policy and Disclaimer of LoveVivah.com.
• Member shall be assigned a dedicated Relationship Manager who will have a one to one session with user to understand the profile & partner preference and thereby help user with the process of match making search during the tenure of LV Elite service.
• Relationship manager will pay a visit to member’s home/office (applicable for members residing in Delhi/ NCR region ONLY) to have a better understanding of their profile and in such process the Relationship Manager may seek certain document confirming the status of the Member the same shall be provided by Member. For locations other than Delhi/NCR, a detailed on call or video session will be arranged.
• With the proper understanding of Member’s profile, an exclusive Profile document will be created, to be shared with other relevant LV Elite members.
• To seek more number of relevant profiles as per member’s requirement, LoveVivah.com may opt to place one Matrimonial Classified (in the entire tenure of service) derived from member’s profile in newspaper or any other media at the sole discretion of LoveVivah.com, masking the name and address of the member. LoveVivah will do the complete screening of profiles before sharing with the Member.
• If a Member has his/her own wish list that they would need assistance in approaching to, LoveVivah.com will work as a mediator in order to initiate the talk and may arrange a meeting subject to the approval of other Member .
• Relationship Manager will endeavor to provide profile(s) as per member’s set partner preference subject to availability of profiles in LV Elite database. LoveVivah.com is under no obligation to furnish any definite number of profiles, if there are none available, which are corresponding to the partner preference set by the member.
• A weekly feedback session will be conducted by the Relationship manager to update member on the progress of the profile and profile management.
• The LV Elite service will be carried out only during normal working hours of LoveVivah i.e., 09:00 am to 06:00 pm Monday to Friday and 10:00 am to 03:00 pm on Saturday.
• Suggestions made by Relationship manager are based on the data furnished by the LV Elite Members in their partner preference. LV Elite Member is expected to exercise due care and caution while proceeding with finalization of marriage with the shortlisted profile.
• Even after the expiry of the service duration, the profile of the LV Elite member shall be retained in the LV Elite database until the Member communicates finalization of his / her marriage or intention not to retain in the database expressly in writing.
• In case there are any new profiles added to the LV Elite database matching Member’s requirement, it shall be communicated to Member even after the expiry of member’s service package.
• We value member’s privacy and understand that the details provided by Member are confidential. Hence, Member’s contact information will be shared with other LV Elite members/prospects only after obtaining member’s consent.
• LoveVivah’s responsibility is limited only to offer match making profiles to LV Elite members based on the partner preference set by LV Elite members. LoveVivah does not guarantee or assume responsibility for any specific result in terms of marriage finalization.
• LoveVivah will not be responsible for the behavior of either of the LV Elite member or his/her accompanying members, during or after the meeting or during any telephonic conversation.
• LoveVivah.com does not give any implied or explicit guarantee or warranty of marriage or alliance or introduction by Member choosing to register for LV Elite services.
• For the marriage alliance finalized through LoveVivah.com, LoveVivah.com will be not be liable for pre or post marriage disputes, if any.

6. Role and Responsibility of LV Elite Member

• Registered LV Elite Member will be required to share his/ her contact details with the Relationship Manager. All the details and data shared by LV Elite Member will be kept strictly confidential, with proper data security measures in place.
• All communication between LV Elite Member & Relationship manager will be privy to LV Elite member only.
• LV Elite Member is required to share his/her Identity Proof with the Relationship Manager and is also expected to furnish educational, occupational and financial documents/ details.
• Any additional information / data required by LoveVivah/ Relationship Manager for profile management shall be provided by the LV Elite Member as and when so sought by Relationship Manager. Time and opportunity loss associated with the delay in response shall be borne by the LV Elite Member themselves and LoveVivah/ Relationship Manager shall not be responsible for the same.
• LV Elite Members are requested to exercise due care and caution while shortlisting the prospect and satisfy themselves before making a choice of match through adequate efforts, initiatives and due diligence. LoveVivah shall not be liable for any issues due to any misrepresentations made by any of its LV Elite members/prospects to the Elite member.
• LoveVivah.com does collect the details of Elite members as much as possible, yet LV Elite members are expected to verify the credentials of the prospect such as family status, educational qualifications, financial status, occupation, character, etc.
• Acceptance by LV Elite member shall be deemed final.
• LV Elite members are expected to provide latest photograph which should not be more than 3 months old. Providing old photographs, inaccurate / false information of their educational qualification and income details shall be treated as violation of terms and conditions. LoveVivah.com shall retain their right under clause 3 (b) of this terms and conditions.
• LV Elite members are expected to disclose their health records during profile enrollment which includes any pre-existing illness, physical disability etc. Non- disclosure at the time of enrollment shall be treated as violation of the terms and conditions and LoveVivah.com shall retain their right under clause 3 (b) of this terms and conditions.
• LV Elite Member cannot use the profile shared to them for the benefit of any third person(s) or for gaining any commercial benefits.
• LV Elite membership is restricted strictly to the registered LV Elite individual Member only. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of LV Elite Group and nor use the LV Elite Service or LV Elite Members data for any commercial purpose. LoveVivah reserve its right to initiate appropriate legal action for such data misuse/theft.
• LV Elite Member shall not assign or transfer his/her LV Elite membership to any other person or entity.
• LV Elite Members cannot put the LV Elite service on hold, even temporarily, for any reasons whatsoever. Based on the tenure of LV Elite service and date of payment taken, the expiry of LV Elite service will automatically happen on expiry of the tenure of the applicable package taken by Member.
• If the LV Elite Member fails to inform LoveVivah/ Relationship Manager about any change in the particulars furnished by LV Elite member then the LV Elite Membership may be suspended at the sole discretion of LoveVivah.
• LoveVivah does not charge any success fee from its members, but in lieu of the marriage finalization through LoveVivah.com, we expect LV elite members to share a text (with Photo)/ video testimonial with LoveVivah.com.

7. Refund Policy

• LV Elite Membership purchase at LoveVivah.com is final. LoveVivah.com does not refund or cancel any membership fees. Membership is co-extensive with the profile. Membership expires as soon as the profile is deleted or terminated, and cannot be reactivated. No refunds will be made in case profile is deleted or inactivated or terminated.
• Any exceptions to refund policy will be made at the sole discretion of LoveVivah. Only in situation where user upgrades to a higher package, then LoveVivah management may decide to adjust the money for unused month(s). No refund will be made if a member upgrades in the last month of the membership plan.
• Jurisdiction and Dispute resolution:
• Any question or difference which may arise concerning the construction meaning or effect of the LV Elite Services or concerning the rights and liabilities of the parties hereunder or any other matter arising out of or in connection with this LV Elite Services shall be referred to a single arbitrator at Gurgaon which shall be appointed by the Tanisha Systems Private limited within 30 days from the written request from the Member.. The decision of such arbitrator shall be final and binding upon the parties. The cost of proceedings shall be borne equally by the parties. Any reference under this clause shall be deemed to be a reference to arbitration within the meaning of the Arbitration Act 1996. The courts at Gurgaon at Haryana (Inida) shall have exclusive jurisdiction in all the matter arising out of Agreement.
